1. Agreement to Terms

By accessing or using the LivingStory service (“Service”), operated by Ideaslake.com (“Company”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

LivingStory is a voice-first life-story preservation platform that enables users to capture, transcribe, organise, and share personal stories. The Service includes voice recording, text entry, file uploads, AI-powered transcription and narration, story collections, and related features accessible via the web application.

3. Accounts and Registration

To use certain features of the Service, you must create an account by authenticating through a supported sign-in provider (currently Google OAuth). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

You must be at least 16 years old to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement.

4. User Content

“User Content” means any text, audio recordings, photographs, documents, and other materials that you upload, record, submit, or otherwise make available through the Service. You retain full ownership of your User Content. By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, process, transcribe, and display your User Content solely for the purpose of providing and improving the Service.

You represent and warrant that:

  • You own or have the necessary rights to your User Content;
  • Your User Content does not violate the rights of any third party;
  • Your User Content does not contain unlawful, defamatory, or harmful material;
  • If your User Content includes the stories, voice, or likeness of another person, you have obtained their informed consent.

5. Gift Subscriptions

The Service may allow you to purchase a gift subscription on behalf of a recipient. By purchasing a gift subscription, you represent that the recipient has consented (or, where the recipient lacks capacity, that an appropriate person has consented on their behalf) to receive story prompts via the designated communication channel (e.g. WhatsApp, email). We are not responsible for verifying recipient consent beyond reasonable measures.

6. AI-Powered Features

The Service uses third-party AI services (including OpenAI and ElevenLabs) to provide transcription, text-to-speech narration, photo description, and other features. You acknowledge that:

  • AI-generated outputs may contain inaccuracies and should be reviewed by you;
  • Audio transcriptions are approximations and may not perfectly reflect the original recording;
  • AI-generated narrations are synthetic voices and do not represent the original speaker;
  • Your content may be processed by third-party AI providers subject to their respective privacy policies and terms.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights;
  • Upload content that is abusive, threatening, obscene, or promotes violence or discrimination;
  • Impersonate another person or misrepresent your affiliation with any entity;
  • Attempt to gain unauthorised access to any part of the Service, other users' accounts, or our systems;
  • Use automated means (bots, scrapers, etc.) to access the Service without prior written consent;
  • Interfere with or disrupt the integrity or performance of the Service.

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Ideaslake.com and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks, logos, and service names may not be used without our prior written consent.

9. Data Storage and Backups

We take reasonable measures to store your User Content securely using industry-standard cloud infrastructure. However, we do not guarantee that data loss will never occur. You are responsible for maintaining your own backups of any content that is important to you. We recommend periodically downloading copies of your stories.

10. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with reasonable notice where possible.

11. Payments and Refunds

Certain features of the Service may require payment. All fees are quoted in the currency displayed at checkout and are non-refundable unless otherwise stated or required by applicable law. We reserve the right to change our pricing with reasonable notice. Payment processing is handled by third-party providers (e.g. Stripe), and your use of payment services is subject to their terms.

12. Termination

We may suspend or terminate your account and access to the Service at our discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to other users or the Service. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. We will make reasonable efforts to allow you to export your User Content before deletion, subject to a 30-day grace period.

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Ideaslake.com, its directors, employees, partners, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

14. Indemnification

You agree to indemnify, defend, and hold harmless Ideaslake.com and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
